Terms of Service

1. Acceptance of Terms
StayBooked.ca ("Company", "we", "us", or "our") provides a web-based platform designed to facilitate appointment booking between service providers ("Providers") and their clients ("Clients"). By accessing or using our services, you agree to be bound by these Terms of Service. If you do not agree, you may not use the platform.
2. Nature of Service
STAYBOOKED IS A TECHNOLOGY PLATFORM ONLY. THE COMPANY DOES NOT PROVIDE PROFESSIONAL SERVICES, MEDICAL ADVICE, BEAUTY TREATMENTS, OR ANY OTHER SERVICES LISTED BY PROVIDERS ON THE PLATFORM.
We act solely as an intermediary to facilitate scheduling and initial deposit collection. We do not employ Providers, nor are we responsible for the quality, safety, legality, or timing of any service booked through the platform.
3. Payment Processing & Stripe
StayBooked integrates with Stripe, Inc. ("Stripe") to enable Providers to collect deposits from Clients. These transactions occur directly between the Provider and the Client.
- StayBooked does not hold, touch, or process funds directly.
- The Company is not responsible for payment disputes, chargebacks, or refunds.
- Providers are responsible for their own Stripe accounts and compliance with Stripe's terms.
4. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STAYBOOKED BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES.
OUR AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE USE OF OUR PLATFORM IS STRICTLY LIMITED TO THE TOTAL AMOUNT OF THE SPECIFIC BOOKING FEE OR DEPOSIT PAID THROUGH THE PLATFORM FOR THE TRANSACTION GIVING RISE TO THE CLAIM.
5. Indemnification
You agree to defend, indemnify, and hold harmless StayBooked and its employees, contractors, and officers from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from: (i) your use of and access to the Service; (ii) any professional services rendered or received as a result of a booking; or (iii) any violation of these Terms.
6. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Province of New Brunswick and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.
